Terms and Conditions

The online store BLVCK.EU is the property of the sole trader company BLVCK APPAREL, registered by Iwona Pyciarz and based in Trablice 68D, 26-624 Kowala, Poland; VAT ID PL7961388629.

Glossary of terms:
Shop - the online shop BLVCK.EU owned and managed by BLVCK APPAREL, selling goods via the Internet at www.blvck.eu.
Working days - the days between and including Monday through Friday, excluding public holidays and weekends in Poland.
Processing time - time in which the seller prepares the order for shipment before it is passed to the courier.

Customer - a natural person or organisation that is not a legal entity, who place an order in the shop.
Customer Account - a set of data used to place an order and viewing order history, containing the client’s preferences of website features and payment history.
Items – all goods offered in the Shop.

GENERAL TERMS
1. The Terms And Conditions page contains information on purchasing good via the Shop’s website operating at www.blvck.eu.
2. The Shop offers only new textile products introduced into the market within all legal means. Any product that has been finished (embroidered, printed or otherwise processed) in Poland contains the label “Made In Poland” in the product description.
3. Contacting the Shop is possible 24 hours a day, 7 days a week at shop@blvck.pl.
4. The Shop sells goods solely via the Internet. We do not own a physical store.

CUSTOMER ACCOUNTS
1. When placing an order, it is possible, however optional, that the customer creates a Customer Account.

2. In order to register and create a Customer Account, the customer must read and accept the Terms And Conditions.

3. Creating a customer Account is possible when placing the customer’s first order in the Shop.
4. If registration is successful, the customer gains access to a specially created account which can be used when placing the next order.

5. Should the customer wish not to create an account, he or she can checkout as Guest.
6. Data provided by the customer in the process of registration or when placing the order without creating a Customer Account must be truthful and up to date.

7. If the information provided appears as incomplete, incorrect or outdated, a representative of the Shop will contact the customer asking for verification. If contacting the customer is not possible, we reserve the right not to process the order.

PLACING AN ORDER
1. The Customer can place an order in the Shop 24 hours a day, every day all year.
2. The processing of an order begins when it is placed and successfully paid for.

3. If payment is not received within 48 hours of placing the order, the order is automatically cancelled by the system. Should the Customer wish to receive the items, another order needs to be placed.

3. The Customer is regularly updated on the order’s status via email.
4. In order to purchase an item or multiple items from the Shop, the customer needs to:
- choose the product(s) and add them to a virtual basket
- provide personal data and shipping address
- choose a payment and a shipping method from those available in the Shop
5. After successfully placing an order, the order summary will be displayed to let the customer know about the item(s) properties, individual item prices, type and price of shipping and the total price as well as the customer’s personal data and shipping address.
5. The order is considered as placed when the customer clicks the ‘Confirm’ button. An order confirmation email will be then sent to the email address provided.
6. If the shop is unable to ship all ordered items, the customer will be informed within 7 working days from placing the order. The notification will be sent to the email address provided. The customer will be fully refunded for the order.
8. If the shop is unable to ship one or multiple and not all items, the customer will be informed on this via email and must decide whether the rest of the items are shipped and a partial refund for the unavailable items is granted or the whole order is cancelled and a full refund is granted.

PRICES AND PAYMENT
1. All transactions are completed in GBP, which is the main currency of the shop. The customer can use the drop-down button to select a preferred display currency. The display currencies of USD and EUR are estimates of the final prices based on the latest currency exchange rates. The final price may differ slightly depending on the customer’s bank exchange rates and conversion fees.
2. The price of the item is not a subject to change once the order is placed.
3. The Shop reserves the right to modify item prices, introduce new items and organise, cancel as well as modify sales events. The Customer order will not be affected if it is placed before the change is introduced.
5. The discounts offered in the Shop do not add up, unless the promotion’s terms state otherwise.

6. The payment methods available are PayPal and credit card payment, securely processed by PayU S.A.

7. If the customer’s payment is unsuccessful, the order will be automatically cancelled by the system. In order to receive the items, placing a new order is necessary.

ORDER PROCESSING AND SHIPPING
1. The order processing time is a maximum of 7 working days from receiving the payment. We always aim to ship the packages as soon as possible, usually within 1-2 days. However, the processing times can differ according to the trading period.
2. All items are shipped from Poland using tracked Polish Post services. The customer is given a tracking number and link in the email confirming the dispatch.

3. If the delivery of the package is unsuccessful, for reasons on the customer’s side including but not limited to incorrect address or recipient not home, we reserve the right to cancel the order and issue a refund, deducting the shipping cost and a 10% processing fee.

RETURNS

1. The customer can return all items without providing a reason within 14 days of receiving them. In that time window, the customer should first inform the shop at shop@blvck.pl and then ship the items back.
2. The items need to be unworn, with original tags attached. If the item bears signs of use, it cannot be returned.

3. To return the items, the customer should ship them back to the address below, including a printed out order confirmation email or a note with the order number:

4. It is the customer’s responsibility to ensure that the return package reaches the shop’s address.

5. The cost of the return package is covered by the customer.
6. After the shop receives the items, full or partial refund of item(s) cost will be processed within 7 working days. For international orders, we are unable to refund the shipping cost.
7. The shop is obliged to deliver items that are new and free of faults. In the rare case of the customer receiving faulty items or the items being not as described, the shop will fully refund the customer or exchange the items for the correct ones, covering all the shipping costs involved.
8. All refunds are issued to the account the customer has used to make the payment for the order - either bank account or PayPal account.

EXCHANGES

1. The customer can exchange any and all items by contacting the shop within 7 days of receiving the order at shop@blvck.pl and shipping the items back.
2. The items need to be unworn, with original tags attached. If the item bears signs of use, it cannot be exchanged.
3. To exchange the items, the customer should ship them back to the address below, including a note with the order number and information which item/size/colour they wish to exchange the item for:

4. It is the customer’s responsibility to ensure that the return package reaches the shop’s address.
5. The cost of the return package is covered by the customer. However, it is the Shop who covers the cost of shipping new items.

6. After the shop receives the items and the exchange is accepted, new items are shipped within the regular order processing time.

CLOSING NOTIONS
1. Since the shop operates in Poland, any cases not covered in Terms and Conditions are subject to the polish law.
2. The shop reserves the right to modify and update Terms and Conditions. The customers who have a Customer Account will be notified about the change(s) via email. Orders placed before the change is implemented will not be affected.
3. The Terms and Conditions are valid commencing 20.07.2014.
